Case 1
In this Traditional divorce settlement offered to my client it showed what appeared to be a 50/50 split. When I asked what the redemption fees and capital gains positions were the client and lawyer didn’t know. With a little digging we found out her soon to be ex was trying to pass to her all the investments with fees and tax still owing while keeping the fee free and tax neutral investments for himself. There were over $80,000 in possible fees and tax he would have pasted to my unsuspecting client.
Case 2
In this Collaborative case, I found a way for the lower income earner to fund going back to school to become self-sufficient and lower the overall cost of spousal support long term. In this long term marriage the full support was only needed for 5 years instead of for life.
Case 3
The mother in this Collaborative case wanted to keep her large family in the large family home. I was able to find a way to make this happen that was agreeable to both clients and still let the other spouse purchase a home.
Case 4
In this Traditional file the client’s ex was hiding income and inflating expenses. After going through all the documents and tracing many complex transfers, I could show that his numbers were not adding up and that he was holding back on cash and that some of his expenses were actually paid for by his work. This difference saved my client $85,000 and allowed her to buy her new home without a mortgage.
Case Studies – Marriage Contact and Estate Planning
Case 5
By using a marriage contract and a spousal trust as part of the estate plan for this couple, a second a marriage for each of them, I was able to assure the couple that either of them would be looked after if one predeceased the other and that there could still be assets left for each of their adult children from prior marriages.
We included the adult children in the final part of the discussion so they understood what was being done and could raise any concerns before the plan was put into place.
